The United States District Court for the Southern District of Ohio has preliminarily approved a class action settlement in Crigler v. Stingray Pressure Pumping LLC, Case No. 2:15-cv-02324-EAS-TPK (“the Lawsuit”). The Settlement Class members are individuals who joined the Lawsuit as plaintiffs or who worked as Stingray Pressure Pumping LLC (“Stingray”) equipment operators or equipment operator trainees between June 3, 2012 and February 24, 2017.

SUBMIT A CLAIM FORM
AND RELEASE AGREEMENT

Submission Deadline:
JUNE 27, 2017.

In order to receive a settlement payment, you must complete, sign, and return a claim form and release agreement by JUNE 27, 2017.

You may submit your claim form and release agreement electronically by clicking here.

If your claim form and release agreement is not completed and signed, or it is not postmarked or submitted online by the deadline, you will not receive a payment and your claims will be released.

DO NOTHING

If you do nothing, or if your claim form and release agreement is not postmarked or submitted electronically by the deadline, you will remain in the Settlement Class, but you will not receive a settlement payment. You will be legally bound by all orders and judgments of the Court, and you will not be able to sue, or continue to sue, Stingray in any lawsuit relating to any claims released in the settlement agreement, including, but not limited to, claims under the Fair Labor Standards Act (29 U.S.C. § 201 et seq.) to the extent allowed by law.

EXCLUDE YOURSELF

Postmark Deadline:
May 13, 2017

You may exclude yourself from the Settlement Class. If you do so, you will receive no benefits or payment. You also will not be giving up any legal claims you may have against Stingray, and you will not be bound by any orders or judgments of the Court. To be excluded, you must send a letter postmarked by May 13, 2017 to Stingray Settlement, Attn: Exclusions, 1801 Market St., Ste 660, Philadelphia, PA 19103 and signed by you explaining that you want to be excluded from the Settlement Class. The letter should include your name, address, telephone number, and the last four digits of your social security number.

OBJECT AND GO TO A HEARING

Postmark Deadline:
May 13, 2017

If you wish to object to the settlement, you must send a letter signed by you and postmarked by May 13, 2017 to the Court at the address below about why you do not like the settlement and, if you plan to attend the fairness hearing, the purpose of your appearance.
